Wakefield man kicked boyfriend so hard he caused a brain haemorrhage, court is told

A Wakefield man who kicked his disabled boyfriend in the head so hard he caused brain haemorrhaging has been jailed for more than two years.

Christopher Lee Jones attacked his 66-year-old partner who had pulled a knife on him after they got drunk and began arguing, Leeds Crown Court heard.

Jones, 40, said he had been acting in self defence, but admitting causing grievous bodily harm after he continued attacking the stricken man as he lay on the floor.

Prosecuting, Jonathan Sharp, said Jones had been dogsitting for his partner's neighbour on the evening of October 19 last year on Blakey Road in Wakefield.

However, Jones ended up at this partner's house drinking with him and another friend.

Shouting was heard at around midnight after Jones got into an argument with the neighbour's son over the dog getting out.

Shortly afterwards Jones got into another argument with the third male in the house where they had been drinking, and Jones attacked the man, giving him a black eye.

Jones' partner, who has mobility problems and struggles to walk unaided, became scared at his loss of temper and so grabbed a kitchen knife to defend himself.

Jones said the victim then attacked him with the knife, leaving him with serious slashes to his arms which required surgery to repair damaged tendons.

Jones then headbutted the victim, knocking out at least two teeth, causing him to drop the knife and fall to the floor.

He then continued laying into the stricken victim, kicking and punching him.

Jones went next door to clean himself up, leaving the victim, who was able to call the police.

When they turned up, they found Jones at the back door of the victim's house, with his shoes covered in blood but claimed he had just woken up.

The victim suffered multiple injuries that doctors initially feared were life threatening, including haemorrhaging, pulmonary contusions (bruising) to both lungs, lacerations to his head and hands and three broken ribs.

He spent nine days in hospital.

Recovering physically, the court was told that the victim was still struggling emotionally and was left unable to sleep and fearing the defendant will return to his home.

After his arrest, Jones said the argument had occurred after he Googled the and found a conviction against his name.

Jones, of Gordon Street, Wakefield, has 13 convictions for 31 offences, including ABH in 2012.

He appeared in court via video link from HMP Leeds, after he was recalled to prison from a previous conviction.

Mitigating Gareth Hudson-Moore said Jones claimed the victim came at him with a knife and the headbutt was in self defence.

He added: "But since he was on the floor, anything beyond that goes beyond self defence.

"He is remorseful. He did not want to hurt the complainant but wanted to protect himself.

"It's a matter of excessive self defence."

Judge Simon Phillips jailed him for 27 months.
